When the US was established the Constitution was an agreement between the states.
Those of us that believe this can prove this pretty easily - states had to agree to the Constitution to be admitted as states. As more states were added they each, essentially, applied for membership in the United States.
And the Constitution is what they agreed to.
Now over time, humans being humans, they saw the need to try to do more with their legislative - and more recently executive - power than what the Constitution allows.
That trend continues to today.
Like many humans the law makers want to take the easy way out. Amending the Constitution is hard (on purpose).
It’s easier to pass a law and see if you can get people to comply.
It’s a real dice roll to challenge the Constitutionality of a law. And it’s costly too.
And honestly you don’t know whether the courts will agree.
But no matter who you talk to the Constitution is supposed to be the limit.
One real possibility for the future is to start holding politicians accountable for whether they uphold the Constitution.
Some politicians don’t care about the Constitution. Some politicians, like New Jersey Governor Murphy, think the Constitution is above their paygrade -
Politicians like this - and those that write and enact laws that are unconstitutional - should be held accountable.
Voters should tell them their actions are unacceptable.
It seems now that most Americans missed their civics lessons in school. We can start with the basics.
And the basics are as simple as everyone should know and uphold the Constitution.
